inheritance order in israel which documents do we need?

When the Decedent has an Israeli ID number, it is not necessary to attach a death certificate. If the Decedent died outside of Israel, and  has an Israeli ID number, it is necessary to update the fact of the death in the Population Registry of the State of Israel, prior to submitting  the application. If the Decedent does not have an Israeli ID number, it is necessary to produce a duly verified death certificate. If it is not possible to produce a death certificate, then it is necessary to submit an application to prove the death in another manner.

How to apply inheritance order

Application handling process

Once your application has been reviewed and received after being correctly submitted, the Inheritance Registrar Secretariat passes the details on for publication in the records and newspaper.

The application is passed on for handling by the Assistant Registrar or an Attorney General representative at the offices of the Custodian General. You may be required to supply additional details and information.

If one of the heirs is a minor, or the heir has been appointed a legal guardian, or an application to appoint a legal guardian for an heir has been made, the application will be passed on for handling by the Assistant Registrar or an Attorney General representative at the offices of the Custodian General.

After the application has been processed by the Assistant Registrar or an Attorney General representative at the offices of the Custodian General, an inheritance order will be granted. If the Assistant Registrar is not authorized to grant the inheritance order, according to section 67a of the Inheritance Law – 1965, the application will be passed on to the Family Courts for handling. The Succession Order is a digital order, which will be sent to the email address of the person who submitted the application or to his representative.

 The Succession Order is also sent to relevant government ministries, banks and  insurance companies. I It will therefore not be necessary to present the Succession Order to  these entities. The following entities and government ministries work in cooperation with the Registrar:

 The Land Registration and Settlement of Rights Department (the Land Registry Office), the Israel Lands Authority, the Ministry of Transport, the Ministry of Foreign Affairs, the Israel Tax Authority, the Israel Corporations Authority, banks and insurance companies. Once you have received the digital order, it is recommended that you keep it on your computer as a file for future use. The Registrar  does not issue printed orders, and it is not possible to receive printed copies of orders from the offices of the Registrar .

 As a rule, a Succession Order should be issued within 40 days from the date of the completed submission of the application for the order (including the period of the publication in the newspaper). Should the application be forwarded  to the Counsel for the Attorney General, his initial response should be given within 30 days from the date on which the application was forwarded. In such event, as a rule, the Succession Order will be issued within 50 days. Should the completion of documents be required, the documents shall be completed through the Registrar  Online – the System for Identifying Files, Performing Actions and Completing Documents. Any delay in the response to the request for the completion of documents or a request for further details will delay the handling of the application. Receiving a Copy of a Digital Order To receive a copy of an order that has been issued by the Registrar , go to the website of the Registrar  Online ,submit an application for an electronic copy of an order and pay  the appropriate fee. If you are in possession of the original file of the digital order that was sent to you, you will be able to use it, and there is no need to request an additional order. The Registrar for Matters of Succession does not issue printed orders and it is not possible to receive copies of orders from the offices of the Registrar for Matters of Succession
